TRIP RELEASE I/We, the undersigned, desiring that _____________________________________ (the “minor”) be allowed to travel with NEXT Worldwide for the purpose of participating in one or more trips organized by NEXT Worldwide, or its representatives. I/we understand the possibility of unforeseen hazards and know the inherent possibility of risk. I/we understand NEXT Worldwide and its representatives will take reasonable safety precautions. On behalf of myself/ourselves, my/our heirs, representatives and assigns, I/we release and forever discharge NEXT Worldwide, its officers, directors, leaders, employees and volunteer staff from and against any and all claims for any and all injuries (including death), losses or damages the minor might have or sustain on or in any activity relating to any such travel whether before, during or after a trip or otherwise. TRAVEL RELEASE I/we understand that travel, particularly for mission purposes, may involve significant risks and that travel to some areas of the world involves greater health and safety risks than foreign travel in general. I/we understand that it is my/our sole responsibility to gather whatever information, such as but not limited to immunizations and State Department travel recommendations, I/we need in order to assess the risk involved in any travel, stay or other activity contemplated by this RELEASE. My/our signature on this RELEASE, and the minor’s participation in any such activity, means that I/we have to my/our full satisfaction obtained all information necessary for me/us to assess risk and to willingly allow the minor to participate. MEDICAL TREATMENT AUTHORIZATION I/we give NEXT Worldwide and its representatives authority to request and authorize medical and/or hospital treatment for the minor’s benefit in the event of any injury or sickness sustained by the minor while on any travel, stay or other activity, including, without limitation, while traveling to and from any foreign country and while within any foreign country. I/we give permission to the physician or dentist selected by NEXT Worldwide and its representatives to secure medical treatment and/or to order an x-ray examination, injection, anesthesia, surgery or any other medical intervention for the minor as deemed medically necessary at the time of injury or accident. I/we agree to pay for all such treatment and to reimburse NEXT Worldwide for all costs and expenses incurred by it with respect to such treatment. MEDIA RELEASE I/we grant permission for photos and videos of the minor to be taken for use in NEXT Worldwide publications. I/we also understand that publication of the photographs and videos may be accomplished electronically via the Internet/World Wide Web (the “Internet”) and that after publication, NEXT Worldwide will be unable to prevent persons from (i) gaining access to the Internet, (ii) copying any photographs and videos of the minor that have been published (or are available on the Internet) from the Internet, and (iii) subsequently using, altering or republishing the photographs or videos without my/our consent. I/we waive any claim for damages against NEXT Worldwide from use, alteration or republication of any photographs and videos of the minor by third parties accessing the Internet. FINANCIAL AGREEMENT All funds that are obtained for this trip are considered charitable contributions to NEXT Worldwide, a 501(c)(3) non-profit organization, and therefore, the property of NEXT Worldwide for federal income tax purposes and therefore non-refundable. Deposits may be transferred to another participant until the Travel Cost Due Date. After this date the deposit becomes non-transferable. There are certain factors (such as the cost of airline tickets, country taxes and the fluctuations in the value of the U.S. dollar) that are beyond the control of NEXT Worldwide. NEXT strives to provide the most accurate and cost efficient trip price, but fluctuating costs of the items aforementioned may cause trip prices to change. NEXT reserves the right to change the location of or cancel a trip when warranted by circumstances beyond the control of NEXT Worldwide. All payment deadlines must be met, otherwise the minor may be subject to an increase in trip cost or a trip cancellation. Once an airline ticket has been purchased, the cost to cover the designated ticket is non-transferable. CANCELLATION POLICY If the minor is not able to go on the trip, the following policy will be in effect. The minor will be allowed to use his/her account balance (minus deposit and airfare charged to that point) towards another NEXT Worldwide trip the following year. If the minor is unable to go on another trip in the next year, the minor’s account balance will go to further the mission of NEXT Worldwide. MEDIATION I/we agree not to hold NEXT Worldwide, its leaders, employees and volunteer staff liable for any damages, losses, diseases or injuries incurred as a result of the minor’s participation on a trip and I/we expressly waive any claims of negligence against NEXT Worldwide and its employees, agents and volunteers. I/we agree with NEXT Worldwide, that any claim or dispute covered by, arising from or related to this RELEASE will be settled by biblically based mediation and, if necessary, legally binding arbitration in accordance with the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation (www.peacemaker.net/site/c.nuIWL7MOJtE/b.5394441/k.BD56/Home.htm). All such mediation and arbitration shall take place in Dallas, Texas. Judgment upon an arbitration award may be entered in any court otherwise having jurisdiction. I/we agree with NEXT Worldwide, that such mediation and arbitration will be the sole means available to me/us for resolving any controversy or claim covered by, arising from or related to this RELEASE. |
